Section 1 - Access and Account
You confirm that you are at least the age of majority in your country of residence and have the legal capacity to enter into a binding agreement. Section 2 - Products
We strive to present our products as accurately as possible. However, differences in screen displays may cause slight deviations in color or appearance. We reserve the right to change product descriptions and prices at any time.
Section 3 - Orders and Conclusion of Contract
Your order constitutes a binding offer to purchase. A contract is concluded only when we confirm the order in writing or deliver the goods. We reserve the right to refuse or cancel any order without providing reasons. Purchases are subject to our Return Policy, which includes your rights under EU consumer law.
Section 4 - Prices and Payment
All prices include VAT unless otherwise stated. Shipping costs and other applicable charges will be displayed separately before checkout. Payments must be made using the methods provided. You confirm that all payment details provided are correct and authorized.
Section 5 - Shipping and Delivery
Delivery times are estimates and non-binding. Title and risk pass to you upon handover to the carrier. We are not responsible for delays caused by shipping providers or customs.
Section 6 - Right of Withdrawal (EU Consumers)
Consumers within the EU have the right to withdraw from the contract within 14 days without giving any reason. Details, conditions, and the model withdrawal form are outlined in our Return Policy.
Section 7 - Intellectual Property
All content, trademarks, and intellectual property on the website are owned by mortify.eu or licensed accordingly. No materials may be copied, used, or reproduced without express written permission.
Section 8 - Third-Party Tools and Links
We may offer tools or links to third-party services. We are not responsible for their content or accuracy and do not assume any liability for interactions with such third parties.
Section 9 - Shopify Platform Notice
mortify.eu is powered by Shopify. However, all sales and contracts are made solely with mortify.eu. Shopify is not a contractual partner in your transactions and assumes no liability.
Section 10 - Feedback and Submissions
Any feedback or content you send us may be used by us without restriction. You grant mortify.eu a non-exclusive, perpetual, and worldwide license to use your feedback in any media.
Section 11 - Errors and Omissions
We are not liable for typographical errors, inaccuracies, or omissions in product information or pricing. We reserve the right to correct errors and cancel or modify orders accordingly.
Section 12 - Prohibited Uses
The Services may not be used unlawfully or in ways that harm others or infringe rights. We reserve the right to terminate accounts that violate these terms.
Section 13 - Termination
We may suspend or terminate your access to the Services at any time, with or without notice. Upon termination, all rights and obligations accrued until that point remain in effect.
Section 14 - Limitation of Liability
To the extent permitted by law, mortify.eu shall not be liable for indirect or consequential damages. Our liability for direct damages is limited to the amount paid by the customer for the relevant order.
Section 15 - Indemnification
You agree to indemnify and hold mortify.eu harmless from any claims arising out of your breach of these terms or your misuse of the Services.
Section 16 - Governing Law and Jurisdiction
These Terms shall be governed by the laws of Austria. If you are a consumer residing in the EU, you may invoke the mandatory consumer protection laws of your country. Jurisdiction is in Graz, Austria, unless mandatory provisions provide otherwise.
Section 17 - Severability
If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Section 18 - Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will take effect upon publication. It is your responsibility to review them periodically.

Abschnitt 1 – Zugang und Konto
Sie bestätigen, dass Sie volljährig sind und über die rechtliche Fähigkeit verfügen, einen bindenden Vertrag abzuschließen. Sie sind für die Vertraulichkeit Ihrer Kontodaten verantwortlich. Alle Angaben müssen wahrheitsgemäß und aktuell sein.

Wir bemühen uns, unsere Produkte so genau wie möglich darzustellen. Farbabweichungen durch Bildschirmeinstellungen sind möglich. Produktbeschreibungen und Preise können jederzeit geändert werden.
Abschnitt 3 – Bestellung und Vertragsabschluss
Ihre Bestellung stellt ein verbindliches Angebot dar. Der Vertrag kommt erst zustande, wenn wir die Bestellung schriftlich bestätigen oder die Ware liefern. Es gelten unsere Rückgaberichtlinien, einschließlich des Widerrufsrechts gemäß EU-Recht.
Abschnitt 4 – Preise und Zahlung
Alle Preise verstehen sich inklusive Mehrwertsteuer, sofern nicht anders angegeben. Versandkosten und sonstige Gebühren werden separat ausgewiesen. Zahlungen erfolgen mit den angebotenen Zahlungsmethoden. Sie bestätigen, dass Ihre Zahlungsdaten korrekt und autorisiert sind.
Abschnitt 5 – Versand und Lieferung
Lieferzeiten sind unverbindlich. Die Gefahr geht mit Übergabe an das Versandunternehmen auf den Kunden über. Wir haften nicht für Verzögerungen durch Dritte oder den Zoll.
Abschnitt 6 – Widerrufsrecht (EU-Verbraucher)
Verbraucher in der EU haben das Recht, binnen 14 Tagen ohne Angabe von Gründen vom Vertrag zurückzutreten. Details dazu finden Sie in unseren Rückgaberichtlinien.

mortify.eu wird über Shopify betrieben. Verträge kommen ausschließlich zwischen Ihnen und mortify.eu zustande. Shopify ist nicht Vertragspartner und haftet nicht für Transaktionen.
Abschnitt 10 – Feedback und Beiträge
Von Ihnen eingereichte Inhalte oder Rückmeldungen dürfen von uns uneingeschränkt verwendet werden. Sie gewähren uns ein nicht-exklusives, unbefristetes, weltweites Nutzungsrecht.
Abschnitt 11 – Fehler und Irrtümer
Wir haften nicht für Tippfehler, Preis- oder Produktfehler. Irrtümer können jederzeit berichtigt und Bestellungen angepasst oder storniert werden.
Abschnitt 12 – Verbotene Nutzungen
Die Nutzung der Dienste darf nicht rechtswidrig erfolgen oder Rechte Dritter verletzen. Wir behalten uns das Recht vor, bei Verstößen Konten zu sperren.
Abschnitt 13 – Kündigung
Wir können Ihren Zugang zu den Diensten jederzeit ohne Angabe von Gründen beenden. Rechte und Pflichten bis zum Zeitpunkt der Beendigung bleiben bestehen.
Abschnitt 14 – Haftungsbeschränkung
Soweit gesetzlich zulässig, haften wir nicht für indirekte oder Folgeschäden. Die Haftung für direkte Schäden ist auf den Kaufpreis der betreffenden Bestellung begrenzt.

Sie stellen mortify.eu von Ansprüchen Dritter frei, die aufgrund Ihrer Vertragsverletzung oder missbräuchlichen Nutzung entstehen.
Abschnitt 16 – Anwendbares Recht und Gerichtsstand
Es gilt österreichisches Recht. Für Verbraucher innerhalb der EU gelten zusätzlich die zwingenden Verbraucherschutzgesetze ihres Landes. Gerichtsstand ist Graz, soweit nicht anders vorgeschrieben.
Abschnitt 17 – Salvatorische Klausel
Sollte eine Klausel dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.
Abschnitt 18 – Änderungen der AGB
Wir behalten uns das Recht vor, diese Bedingungen jederzeit zu ändern. Änderungen treten mit Veröffentlichung in Kraft.
